Applies to: All riders using LAnow microtransit services
1. Purpose
This policy ensures that LAnow complies with California child passenger safety laws and promotes the safety of young riders during transportation. It also defines the responsibilities of parents/guardians in securing proper child restraint systems.
2. Legal Requirements
Per California Vehicle Code § 27360 – 27368, the following applies:
- Children under 2 years old must ride in a rear-facing car seat, unless the child weighs 40 pounds or more or is 40 inches or taller, in which case other approved restraint types may be used.
- Children under 8 years old must be secured in a child safety seat or booster seat and ride in the back seat unless an exception applies.
- Children who are 8 years of age or have reached 4′9″ (whichever comes first) may use a regular seat belt, assuming it fits properly per manufacturer guidelines and law.
3. Rider Responsibilities
- Parents/Guardians are solely responsible for providing, installing, and securing their child in a legally compliant Child Restraint System (CRS), such as a car seat or booster seat once on board the vehicle.
- LAnow does not provide Child Restraint Systems (CRS), e.g., car seats or booster seats.
- In cases where a legally required child restraint system is not available, boarding may not be permitted in order to maintain compliance with California law and prioritize child safety.
4. Vehicle Information
- LAnow vehicles are equipped with standard seat belts but are not equipped with built-in car seats or booster seats.
- Riders must ensure any personal car seats are compatible with standard vehicle seat belt systems.
5. Liability Disclaimer
- LAnow and the City of Los Angeles are not responsible for any injury, fine, or legal consequence resulting from a rider’s failure to provide or properly secure a child in a compliant restraint system.
- By using the LAnow service, riders accept full responsibility for complying with California child restraint laws.
6. Driver Authority
- Service may be declined if a child is not safely and legally restrained, in accordance with applicable regulations.
- This is to protect all passengers and maintain compliance with state law.
